Terms of Service

1. Acceptance

By registering for or using the SovereignMesh platform, you agree to be bound by these Terms of Service. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the platform.

2. Eligibility

The platform is available to Australian-registered businesses and individuals with a valid ABN. You must be at least 18 years old and must not have been previously suspended or removed from the platform.

3. Account responsibilities

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at security@sovereignmesh.com.au of any unauthorised access. You may not share accounts or create multiple accounts for the same organisation without written consent.

4. Acceptable use

You may not use the platform to: (a) submit false or misleading certification documents; (b) circumvent the verification process; (c) harass, impersonate, or defraud other users; (d) violate Australian export control laws, including DSGL obligations; (e) attempt to gain unauthorised access to any system or data.

5. Vendor verification

Vendor profiles and Sovereign Badge statuses reflect information provided by vendors and cross-checked against available registers at the time of verification. Buyers acknowledge that certifications may change between verification cycles and should conduct their own due diligence for critical procurements.

6. Intellectual property

SovereignMesh retains all intellectual property rights in the platform, including its software, design, and database structure. You retain ownership of content you upload (documents, profiles, bid materials) but grant us a limited licence to display, process, and transmit that content as required to operate the platform.

7. Fees and billing

Subscription fees are billed in advance on a monthly or annual basis in Australian dollars (AUD) inclusive of GST. Unused portions of a subscription period are non-refundable except where required by Australian Consumer Law.

8. Limitation of liability

To the extent permitted by law, SovereignMesh's liability for any claim arising from use of the platform is limited to the fees you paid in the three months preceding the claim. We are not liable for indirect, consequential, or punitive damages. Nothing in these terms excludes liability for fraud or rights under Australian Consumer Law that cannot be excluded.

9. Termination

Either party may terminate at any time with 30 days' written notice. We may suspend or terminate accounts immediately for material breach of these terms, including submission of fraudulent credentials. On termination, your data will be available for export for 30 days before deletion.

10. Governing law

These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of NSW courts, except for claims that may be brought in a small claims tribunal.
